Tea in Trade Dress Dispute: HC restrains 'Tea Curry' and 'Just Vedic' having same trade dress as 'Chaayos', Read Order

In a recent legal dispute, M/s Sunshine Teahouse Ltd., the owner of the brand name 'CHAAYOS,' known for its tea and related products, filed a suit against M/s Grey Mantra Solutions. The plaintiff alleged that the defendant was selling products using the brand names 'TEACURRY' and 'JUST VEDIC' on various online platforms, including Amazon.

The plaintiff, with a strong presence in India and international markets, had invested significantly in promotional and advertising activities for its 'CHAAYOS' brand. They claimed that the defendant had copied various distinctive elements of their packaging, creating a substantial imitation of their trade dress. This included similarities in colour schemes, wording styles, creative embellishments, and depictions of elements like flowers and spices.

The plaintiff had initially attempted to resolve the dispute through communication, but the defendant's response did not lead to a resolution. Moreover, the defendant's online listings closely resembled those of the plaintiff.

The Delhi High Court acknowledged the plaintiff's numerous trademark registrations and distinctive packaging, affirming that the defendant had imitated these elements.

The High Court noted the potential for consumer confusion due to the striking similarities between the two trade dresses.

As a result, the Court restrained the defendant from manufacturing new tea products in the contested trade dress packaging and ordered the removal of the infringing online listings. The defendant was directed to provide details of their existing inventory.
