Shein Sues Rival Temu, Alleging Intellectual Property Theft and Fraudulent Practices

In a high-stakes legal battle, Chinese fast-fashion giant Shein has filed a lawsuit against its rival Temu, accusing the e-commerce platform of widespread intellectual property theft, fraud, and counterfeiting. The lawsuit, submitted on Monday to a federal court in Washington, D.C., claims that Temu, controlled by PDD Holdings, has built its empire by copying Shein's ideas and using fraudulent tactics to gain an edge in the competitive fashion industry.

Shein's complaint alleges that Temu is "masquerading" as a legitimate online marketplace while incentivizing its sellers to steal designs from other businesses. According to the lawsuit, Temu then prohibits these sellers from removing their products from the platform, even after they have admitted to the infringement. Shein argues that Temu is luring American consumers with low prices, but is actually losing money on each transaction due to the subsidies required to maintain these prices.

"Temu can only hope to minimize the massive losses it is subsidizing by encouraging its sellers to sell counterfeit or substandard goods and violate others' intellectual property rights," Shein asserts in its complaint.

A representative from Temu responded sharply, calling Shein's accusations "unbelievable." The spokesperson stated, "SHEIN dares to fabricate accusations against others for the misconduct they're repeatedly sued for, buried under its mountain of IP lawsuits."

Both Shein and Temu have made headlines for their aggressive strategies in the retail sector, characterized by ultra-low prices and a rapid response to fashion trends. However, they have also faced significant criticism over their labor practices, alleged connections to the Chinese government, and purported intellectual property infringements.

This is not the first time the two companies have clashed in court. Last year, Temu filed its own lawsuit against Shein, accusing the company of copyright violations and alleging that Shein intimidates suppliers "mafia-style" into signing exclusive deals.

In the latest lawsuit, Shein accuses Temu of engaging in "brazen" illegal activities, including stealing trade secrets to gain a competitive advantage. Shein claims that at least one Temu employee accessed confidential information about Shein's top-selling products and internal pricing data. Temu allegedly used this stolen data to instruct its vendors to replicate popular Shein products and sell counterfeit versions on Temu's platform.

"Temu is not your average infringer," the lawsuit states. "Temu has reproduced nearly identical copyrighted images of Shein products and used them, or instructed sellers to use them, as promotional images on the Temu website and mobile application to advertise the counterfeit versions of Shein products."

Shein's complaint also accuses Temu of impersonating Shein on the social networking platform X and misleading consumers with deceptive advertising. The lawsuit includes a screenshot of a Google ad sponsored by Temu that features Shein in the headline but directs users to Temu's website. Additionally, Shein alleges that Temu has instructed its paid social media influencers to falsely claim that Temu's products—often counterfeit Shein items—are of higher quality and more affordable than those offered by Shein.

The eighty-page complaint includes more than a dozen examples of clothing and designs that Temu is accused of stealing. Shein is seeking a court ruling in its favor, along with an injunction to prevent Temu from exploiting Shein's private information and intellectual property. The legal battle between these fast-fashion titans is far from over, as both companies continue to vie for dominance in the global retail market.
