Rajat Sharma and India TV Score Legal Victory in Trademark and Personality Rights Case

Veteran journalist Rajat Sharma and his news channel, India TV, have secured a significant legal victory in the Delhi High Court. The Court issued an interim order protecting their trademarks, logos, and Sharma's personality rights from unauthorized use.

The lawsuit stemmed from the illegal exploitation of intellectual property by a third party identified as "Jhandiya TV." Jhandiya TV was allegedly using logos and the name "Baap Ki Adalat," which bear a deceptive resemblance to India TV's "Aap Ki Adalat" program and logo.

India TV and Sharma had filed a lawsuit seeking a permanent injunction to prevent such infringement. The Delhi High Court, acknowledging the merits of their case, issued an interim order granting the following protections:

 

  • Trademark and Logo Protection: The infringing party and its associates are prohibited from using any variation of the trademarks or logos "India TV," "Aap Ki Adalat," or confusingly similar marks across various platforms. This includes social media posts, domain names, audio-visual content, trademarks, trading names, and related services.
  • Personality Rights Protection: To safeguard Rajat Sharma's personality rights, the Court barred the infringing party from using his image, video, or name in any format. This prohibition extends to trademarks, logos, trading styles, domain names, social media posts, audio-visual content, and related services.
  • Content Removal: Social media platforms like [X] (formerly Twitter), YouTube, and Facebook are directed to remove infringing content identified by India TV, including social media posts and links containing the infringing trademarks and logos, along with any other deceptively similar marks mentioned in the lawsuit.

This interim order serves as a crucial step in protecting Rajat Sharma and India TV's intellectual property and reputation. The case highlights the importance of safeguarding fundamental rights in today's digital age, where information spreads rapidly. The Court's decision underscores the need for robust intellectual property protection to ensure rights holders' integrity, reputation, and business interests in the ever-evolving digital landscape.
