McDonald’s not ‘Big’ enough for Supermac’s

European Union (EU) has stripped the American fast food company McDonald’s of its Trademark on their iconic Big Mac burgers in Europe after a legal challenge by an Irish restaurant chain.

Irish-based fast food chain Supermac’s and McDonald’s were engaged in a Trademark battle for quite some time and apparently, the famous fast food joint McDonald’s was the one to taste the bitterness of defeat.

Supermac’s owner Pat McDonagh said, “We knew when we took on this battle that it was a David versus Goliath scenario but, just because McDonald’s has deep pockets and we are relatively small in context doesn’t mean we weren’t going to fight our corner.”

The lawsuit started when McDonald’s attempted to stop Supermac’s from expanding their food chain throughout the European Union. McDonald’s claimed that the name Supermac’s would confuse their customer with McDonald’s most famous Big Mac burger.

European Union Intellectual Property  Office ruled that McDonald’s was not putting the Big Mac Trademark to genuine use and hence delivered the judgement in favour of Supermac’s.

The result of this lawsuit will be that Supermac’s can now expand their chain throughout the United Kingdom and that McDonald’s no longer has the right to their Big Mac Trademark in European Union.

Supermac’s has over 100 restaurants across Ireland and can now expand outside the country courtesy of this lawsuit victory. McDonald’s now has the opportunity to appeal the decision, should they choose to do so, but not a single statement has been released by the fast food company since their defeat in the lawsuit.
