In the case of M/s. Sathya Movies vs M/s.Suresh Production Entertainment Private Limited, Madras High Court passed its judgement in the favour of M/s. Sathya Movies, Plaintiff, which claimed its ownership over the title of the movie.

Plaintiff claimed that it was entitled to protect the title of its film, and in the absence of any defence from the defendants, the Court seized the defendants of using it, without any further examination of the merits of the plaintiff’s claim to the film title.In 1966, the Plaintiff, a partnership Company, produced a Tamil film called ‘Naan Aanaiittal’ and said that it was registered with the Tamil Film Producers Council.

It came to the notice of the plaintiff through newspapers that the defendant, without their consent, used the name title for their film.

After issuing notices to the defendant, the President, Film and Television Producer Guild of South India, Film Chamber of Commerce, Film Producer's Council and Distributors Association starting from August 17, 2017, the defendant didn’t respond and continued to proceed to the release of the movie.

In absence of any defence from the defendant, the matter was ordered to be posted under the caption, ‘Undefended Board’ on February 26, 2018.

High Court ordered that the defendant is not entitled to use the title and was adjourned.
