A hijab in modern Arabic usage is a veil worn by some Muslim women in the presence of any male outside of their immediate family, which usually covers the head and chest. Most lawsuits brought on by fashion brands in Malaysia involve Trademark Infringement, but it was the first time a decision was reached on an Intellectual Property of such nature says Bokitta.
The unnamed company mentioned above was selling Bokitta-style hijab under its own brand name and argued that instant hijab had existed for years. But Bokitta owns a Malaysian Patent on the design, proving that it was unique and first of a kind in the world. It also stated that any company selling this wrapped-style instant hijab is infringing on its patent.
Bokitta hopes that the Court’s decision will encourage other parties to come up with their own invention and innovation, especially in the field of fashion. Bokitta also added “This Court’s decision sends a strong message to those who venture into wrong and haram ways in life to make a living by stealing other people’s Intellectual Property or stealing other valuable properties.
