Angry Birds drags Angry Birdz Nashville "Hot Chicken" to the Court for Trademark Infringement

July 24,2019:

Rovio Entertainment accused Angry Birdz Chicken of trademark dilution for using the similar logo. The restaurant named "Angry Birdz Nashville Hot Chicken" features menu card with recipes of menu and logo. The logo is similar to the Angry Birds mobile game.

The logo has the same colour and font of that of Angry Birds. The plaintiff severely communicated with the defendants to cease and desist them but they paid no heed to the words of the plaintiff.

The plaintiff filed a lawsuit in the U.S. District Court for the Central District Court of California which states that the restaurant is breaching its trademark with their "Angry Birdz" restaurant.

It is a case of trademark infringement. Logos are one of those spaces of intellectual property law where there is a great deal of overlap between two areas that are copyright and trademark. Businesses are known for using both to protect their logos from undesired use. Trademark is about securing things that identify a business in the marketplace and logos are among the most important means of identification. Logos are generally protected by trademark and enforceable as such.

Angry Birds is a video game franchise created by the Finnish Company Rovio Entertainment. Angry Birdz restaurant is a famous eating place in Los Angeles. Rovio Entertainment is seeking an unspecified amount of money and also claimed past profits of that restaurant. The plaintiff alleged that the marks of the infringer are causing confusion among the consumers. The Finnish Studio and Rovio prayed for an interim injunction against Angry Birdz Chicken Restaurant and requested the destruction of infringing goods.

On June 20th 2019, the case was filed. Last year a similar case was filed where Nintendo Co. Ltd., Japanese multinational consumer electronics and video game Company headquartered in Kyoto. A case was filed against go-cart company Maricart, which was adapted from Mario Kart. Nintendo Co. Ltd. is the owner and they won the case. It is to see whether Rovio becomes successful in prohibiting the restaurant from using the logo in the future.
