January 05,2019:
WeMade claims that 37Games’ web game ‘Legend of Dominance Tour’ infringed the Copyright of ‘The Legend of Mir 2’.
‘Legend of Dominance Tour’ was released at the end of 2014 and has gained a lot of popularity in China. WeMade filed a lawsuit in April 2016 with a Beijing Court specializing in intellectual property, asking the Court to force the Chinese firm to stop the services of the game which used the idea of ‘The Legend of Mir 2’ without paying fair prices.
37Games claimed it did not infringe the copyright of the Korean game because a sub-license had been signed with China’s Shanda Games. Shanda Games is to publish ‘The Legend of Mir 2’ but has caused conflicts because it granted sub-license of the game without WeMade’s permissions. This led to a long legal battle between Shanda Games and WeMade Entertainment.
But the Court did not accept any of it and ultimately WeMade won the infringement lawsuit. The Court accepted WeMade’s argument concluding that ‘Legend of Dominance Tour’ infringed the copyright of ‘The Legend of Mir 2’.
The Court ruling demands 37Games to stop the service of ‘Legend of Dominance Tour’ immediately and discard all related data. Also, 37Games is trying to negotiate with WeMade Entertainment to get an official license considering the popularity of their game in China.
