The Supreme Court, while hearing a batch of petitions challenging the constitutional validity of the Waqf (Amendment) Act, 2025, heard extensive arguments from the petitioners questioning the scope, intent, and provisions of the newly enacted law.

Senior advocates Kapil Sibal and Abhishek Manu Singhvi, appearing for the petitioners, objected to the limited framing of issues and urged the Court to conduct a broader constitutional examination. They raised concerns about procedural safeguards, arbitrary restrictions on creating Waqf, and provisions allowing administrative authorities to adjudicate Waqf disputes.

Chief Justice BR Gavai, heading the Bench along with Justice AG Masih, reiterated the presumption of constitutionality attached to parliamentary laws, cautioning against premature judicial intervention unless clear unconstitutionality is demonstrated.

The Bench is expected to hear the Union Government’s response tomorrow. The matter remains under active consideration, and the next round of arguments is scheduled for continuation.
