The hardships of Lawyers due to the ongoing Lockdown concerning to the Global Pandemic is an open secret.

Similarly, efforts of the Bar Councils and Associations to make up to the needy Lawyers for the same were also not hidden.

In this regard, a petition has been filed in the Supreme Court stating that Government has remained a mute spectator to the hardships faced by Lawyers and hasn't made any genuine efforts expected out.

The Top Court though has dismissed the same and observed that the petition could not be filed invoking Article 32 of the Constitution.

Petitioner Advocate Abhinav Ramkrishna had urged the Court to issue directions so that the Government coordinate with State Bar Councils, to formulates a Uniform Welfare Scheme for all Lawyers in need of aid amid Lockdown.

He mentioned that Lawyers are facing extreme difficulties to sustain themselves in times of economic crunch arose out of the uninvited Pandemic scenerio.

The petition read:

"The government, Bar council of India and state bar councils cannot be expected to be in a state of deep slumber or be insensitive towards the economic and mental hardship faced by lawyers, except few upon who have achieved a milestone by dint of their hard work and acumen"

The Court though while taking up the plea enunciated that the plea could not have been filed under Article 32 of the Constitution.

The Bench comprising of Justice Ashok Bhushan, Justice Sanjay Kishan Kaul and Justice B.R. Gavai clarified that the Article gets invoked on the violation of the Fundamental Rights guaranteed under the Constitution.

The petition criticized the Bar Council of India as it announced the Wellfare Scheme for Lawyers but on ground level it serves no purpose as the amount to be disbursed has been kept undecided.

The order has been passed by a Bench comprising of Justice Ashok Bhushan, Justice Sanjay Kishan Kaul and Justice B.R. Gavai on 08-05-2020.
