On Tuesday, the Supreme Court denied to exclude the time period of Lockdown for calculating the limitation for presentation of cheque/demand draft stating that it is to be decided by the Central Bank only.
The petitioner herein has sought the above relief under Article 32 of the Constitution of India in view of the direction issued by the Reserve Bank of India vide Notification dated 04.11.2011.
The Top Court observed that it is a policy decision be to be taken by the Reserve Bank of India only and the Court cannot issue any direction regarding this.
It thus dismissed the petition.
The order has been passed by bench comprising of JUSTICE R. BANUMATHI, JUSTICE INDU MALHOTRA and JUSTICE ANIRUDDHA BOSE on 02-06-2020.
