Recently, the Supreme Court Bar Association has issued a strongly worded resolution condemning the alleged conduct of Nitish Kumar during a public ceremony in Patna, describing the episode as a grave affront to a woman’s dignity, autonomy and constitutionally protected freedoms.

In its resolution dated December 20, the SCBA referred to an incident stated to have occurred on December 15 at an official function in Patna, where the Bihar Chief Minister allegedly pulled down the hijab of a woman doctor in public. The Bar body expressed deep concern that such an act was attributed to a person holding a high constitutional office.

The Association asserted that forcibly pulling down a woman’s headscarf violates her personal dignity and directly infringes her autonomy, agency and religious freedom. It also condemned what it termed “vile and derogatory comments” made by Giriraj Singh and Sanjay Nishad, stating that such remarks undermine the dignity of women and reinforce discriminatory attitudes.

The SCBA observed that the alleged act reflects a “depraving attitude against women in general” and strikes at the core principles of equality and non-discrimination enshrined in the Constitution of India. It noted that conduct which demeans a woman in a public setting erodes constitutional values and the rule of law.

Condemning the incident in the strongest terms, the SCBA demanded an unconditional apology from those responsible and reaffirmed its commitment to the protection of individual rights, the dignity of women and constitutional governance. The resolution was issued under the signature of Pragya Baghel following deliberations by the Association’s President and Executive Committee.
