Addressing the Bar Council of India's International Lawyers’ Conference 2023 on ‘Emerging Challenges in Justice Delivery System’, Law Minister Arjun Ram Meghwal lauded the Supreme Court of India for hearing the most number of cases in the world during the unforeseen Covid-19 pandemic.

The Minister was shedding light on the Tele-Law initiative and the e-courts platform when he highlighted the exceptional performance of India's Top Court during a drastic time.

He enlisted the major developments made in the tenure of the Modi Government in the areas of business, finance, industries, investments, etc. with priority. He pointed out that the development and promotion of the Alternate Dispute Resolution mechanism has really kicked off in the past years. 

He affirmed the Government's stance to diversify dispute resolution in the country and cited various steps taken to solidify the position of  Contract Enforcement and Commercial Dispute Resolution to enhance the ease of doing business and increase the confidence of investors.

He went on to cite examples such as the introduction of the Commercial Courts Act 2015 and the starting of compulsory pre-mediation procedures in cases, calling it a major intervention in commercial law.

Next, he cited the passing of the 2015, 2019, and 2021 Amendments to the Arbitration and Conciliation Act 1996 to strengthen the position of ADR as a more visible form of dispute resolution. He stated that the aim was to promote institutional arbitration, adoption of global practice and to remove ambiguity along with the establishment of an arbitration ecosystem.

Lastly, he cited the recent passing of the Mediation Act 2023. 

With regard to 'Access to Justice and Legal Aid in Developing Nation', he said that the same is a fundamental human right that ensures individuals can seek and obtain a fair and impartial resolution to their disputes.

He also reinforced the Government's commitment to develop judicial infrastructure.
