The Patna High Court recently granted anticipatory bail to Radhe Sharma, who was accused of violating the Environment (Protection) Act (EPA), 1986, in a mining case. Justice Anjani Kumar Sharan allowed Sharma's bail application on the condition that he plant 500 saplings and take care of their upkeep for six months.
Sharma faced charges under the Bihar Minor Mineral Concession Rules, 1972, and was alleged to have breached an environment protection certificate issued under Section 15 of the EPA. The said section provides for penalties, including imprisonment of up to five years or a fine of up to Rs 1 lakh, or both. If the offense continues beyond one year, the imprisonment term can extend up to seven years.
Advocate Naresh Dixit, representing the Bihar mines department, informed the court that they had no objection to granting bail if Sharma committed to planting 500 trees. The saplings would be provided free of cost by the district mines officer, and Sharma would be responsible for their upkeep for six months. The advocate emphasized that the bail should be cancelled if Sharma fails to fulfill this condition.
Sharma's defense argued that the allegations against him were general and lacked specificity, asserting that he had not violated any environmental norms and was falsely implicated.
The court agreed with the mines department's proposal and granted Sharma anticipatory bail on the condition of tree plantation and maintenance. However, the court made it clear that if Sharma failed to adhere to the specified terms and conditions, the mines department could apply for the cancellation of his bail.
The Patna High Court's decision reflects a growing trend in Indian courts to link bail conditions with environmentally responsible actions. Similar orders have been issued by the Delhi High Court, Punjab and Haryana High Court, and Madhya Pradesh High Court in previous cases. These green bail conditions aim to encourage environmental consciousness and promote responsible citizenship, fostering a positive impact on the environment amid various legal proceedings.
