A Division Bench of the Madras High Court, comprising Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy, has in the case of M.Karpagam v. Commissionerate for the Welfare of Differently Abled & Ors. indicated the State to file a more detailed and lucid report as the report on how various categories of differently-abled people were proposed to be vaccinated. The Court stated that the report which was submitted was completely vague and did not make any distinction between several classes of differently-abled persons.

The Bench expressed that,

“It is hoped that a more detailed report will be filed by the State indicating how various categories of differently-abled people are proposed to be vaccinated, including those who are unable to leave their homes and maybe in distant parts of the State.”

Factual Background

The Petitioner named M.Karpagam had filed for issuance of a Writ of Mandamus directing the respondents to frame a standard operating procedure for vaccinating homebound persons with disability persons at Institution's nursing homes etc.

Court Reasoning & Judgment

The Court looked into the report submitted by the State and opined that the status report runs into three pages and the relevant matter is found in paragraph 6, which is completely vague and does not make any distinction between several classes of differently-abled persons, particularly those who are homebound and completely unable to travel outside.

The Court ordered the State that,

“A comprehensive set of instructions to be issued to appropriate officials in the State should be prepared and appended to the status report that should be filed when the matter appears next a week hence.”

The Court posted the matter on 30.6.2021 for the next hearing.
