A Division Bench of the Madras High Court, comprising Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy has issued a notice in a Public Interest Litigation, challenging the State government's move to constitute a nine-member committee to study the impact of the National Eligibility cum Entrance Test (NEET) for medical admissions on socially backward students (K Nagarajan v. Union of India and Ors.).

Factual Background

The Petitioner is the General Secretary of the Bharatiya Janata Party (BJP), Tamil Nadu, Karu Nagarajan. He filed the plea, basing his contentions on the view expressed by the Apex Cort in its Order dated August 22, 2017, wherein the Court made observations to the effect that the State of Tamil Nadu shall not make any kind of distinction or discrimination between the examinations conducted by various Boards, and admissions shall be effected as per the result of the NEET examination. Yet the State formulated the Committee."

Hence, aggrieved by which, the petitioner filed PIL under Article 226 of the Constitution of India before this Court.

Court Reasoning & Judgment

The Court considered all the suggestions made by the Petitioner as setting up of the Committee is an exercise in futility since any recommendation that such Committee may make, cannot be implemented in the light of the view taken by the Supreme Court on NEET and thus Ordered the State to file its counter-affidavit before the matter appears a week hence.

During the hearing, Chief Justice Sanjib Banerjee orally observed that since the Supreme Court has issued such positive directions for the implementation of NEET, it is completely futile to set up a committee to study the impact of NEET.

The court has also asked the Central Government to indicate its stand on this issue. The Bench had listed the matter on 05.07.2021 for the next hearing.
