In a recent development reflecting the judiciary's approach to personal liberty and protection under Article 21 of the Constitution, the Delhi High Court on June 14 directed the local police to extend full protection to an interfaith couple, following the woman’s conversion to Hinduism prior to marriage. The order was passed by Justice Girish Kathpalia in a petition seeking protection due to threats faced by the couple on account of their inter-religious union.
The petitioners, a recently married couple, approached the Delhi High Court seeking protection of their "life and limb" after the woman converted to Hinduism and entered into marriage with the man. The petition was filed in light of alleged threats and apprehensions to their safety. The couple resides within the jurisdiction of the Jaitpur Police Station.
Although the matter was listed for hearing on June 14, no one appeared on behalf of the petitioners. The Additional Standing Counsel informed the Court that the petitioners' counsel had intimated the Investigating Officer, Inspector Satbir Singh of Jaitpur Police Station, about their intent to withdraw the petition. However, no formal withdrawal application was filed before the Court.
Justice Girish Kathpalia, while noting the absence of representation, refrained from dismissing the petition. The Court remarked: "Keeping in mind the risk to life and limb of petitioners, I do not feel inclined to dismiss the petition in their absence." In addition, the Court emphasized the importance of verifying the voluntary nature of the woman’s decision to cohabit with her spouse, stating: "To ensure that the lady petitioner is voluntarily living with the petitioner's Husband, it is directed that both petitioners appear on the next date through videoconferencing."
The Court directed Inspector Satbir Singh to communicate the order to the Station House Officer/Station Officer of the area concerned, mandating them to ensure "complete protection" to the petitioners. The matter has been listed for further hearing on July 7, 2025, and the Court has called for a status report to be filed within four weeks.
