The Allahabad High Court has issued certain directions to implement the guidelines of Unlock 4 in the state and expressed its concern over wider spread of Covid-19 in the state due to non- compliance of these Government guidelines by the general public. 

The petitioner has expressed his apprehension before the court that now when Unlock-4 is there for the purposes of bringing back the economy on its track the way it was before the lockdown was imposed on 25th March 2020, people would go out in the open resulting in a wider spread of COVID-19 infection.

Further, the petitioner has submitted that,

 “Rampant infection might infect a large number of the population without any control and, therefore, prayed that appropriate directions be issued to ensure that the COVID-19 Guidelines issued by the Government be implemented by the Government in its letter and spirit very religiously.”

To deal with such critical condition of spread of Covid-19 in state, the Division Bench comprising of Justice Siddhartha Varma and Justice Ajit Kumar has passed the directions to prevent the spread of coronavirus.

In our considered opinion there has to be a comprehensive strategy to ensure absolute compliance of wearing of masks and of social distancing norms by our people” expressed the Court.

The court has directed the District Administration of Prayagraj to install sufficient number of high-end CCTV cameras to inspect the people that whether they are following the protocol of social distancing at public places or not. The court further directed that when the CCTV footage is reviewed by the Zonal Officers of the Nagar Nigam then they shall report the matter to the Senior Superintendent of Police, Prayagraj, “who shall immediately take action against the police official posted in the area where it is found that people were conglomerating and were violating the COVID 19 Regulations of maintaining physical distancing and wearing of masks.”

The court has asked to the State Legal Services of Uttar Pradesh to appoint Advocate Commissioners in consultation with the Municipal Commissioner, Prayagraj Nagar Nigam for overseeing the condition and work to ensure the implementation of the guidelines issued by the state government. The court has directed to the Advocate Commissioners that they shall report any violation of the COVID-19 Guidelines immediately to the Zonal Officer of the Nagar Nigam who shall in his turn take suitable steps against the person who violated the directions.

The court has directed the state to take stringent actions and measures which necessary for the protection of health and care of the people from Coid-19. State must provide medical facilities to curb the spread of Covid-19.

“The State may revitalize its Primary Health Centers and other dispensaries in the urban, suburban and rural areas. Collection centres of samples for testing the COVID-19 virus be there in all such health centres all over the district.” Directions passed by court.

The court strictly remarked that there must be no commercial activity allowed in areas which is declared containment zones by the Administration.  And all the lawyers in the State would enter Court premises with masks on their face and will wear it throughout the Court hours while they are in the Court premises.
