The Madras High Court observed that the contentions raised by the petitioner to allot the centres for NEET Exam in nearby areas was too late to be recognized, if recognized it will make the situation more complex as exam was scheduled on 18 April 2021.

“It is too late in the day to take cognizance of the petition and to inject confusion into the already troubled system.”

The above observation was made by the Division Bench of Madras High Court, comprising of Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy while dealing with the Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus directing the second respondent to provide sufficient additional examination centres and seats therein in the State of Tamil Nadu for the National Eligibility cum Entrance Test-PG 2021 (NEET-PG 2021) enabling the candidates from Tamil Nadu to exercise their option of the centres in Tamil Nadu.

Factual Background

The petitioner was a NEET aspirant who was appearing for the year 2021. The Petitioner raised a contention that all the nearby centres were filled within few hours of opening the form. Since in the wake of Covid second wave, it will be inconvenient for the aspirants as they had to travel to another state as well. Therefore this petition was filed in this Court for seeking order to respondent to provide additional centres in the State.

Court Reasoning & Judgment

The Court took the note of the dates on which admit cards were allotted i.e. 25 th March and the petition was brought to the Court on 23 rd March and held that:

“it is too late in the day to take cognizance of the petition and to inject confusion into the already troubled system”.

The Bench dismissed the petition and advised Centre to took all the necessary steps in future examinations and ensure that more than necessary seats are allotted in cities and towns in this State so that candidates can enjoy the convenience.
