A Division Bench of the Madras High Court comprising Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy has in the case of M. Karpagam v. Commissionerate for the Welfare of Differently Abled & Ors. granted a time period of 15 days to the State to formulate a policy for the vaccination of homebound persons as it required more detailed study. The Court also noted that these people were more prone to contracting the COVID-19 virus.

“A more detailed study requires to be conducted as to the initiatives to be taken to deal with the vulnerable classes referred to by the petitioner.”

Factual Background

The Petitioner named M.Karpagam filed for issuance of a Writ of Mandamus directing the respondents to frame a standard operating procedure (SOP) for vaccinating homebound persons with disability persons at institutions, nursing homes, etc.

Court Reasoning & Judgment

The Court considered all the facts of the case and looked into the contents of the report filed by the State and stated that a more detailed study was required to be conducted highlighting the initiatives to be taken by the State to deal with the vulnerable classes referred to by the petitioner.

The Court gave a fortnight period to the State to prepare a road map for the same and posted the matter on 21.6.2021 for the next hearing.
