On Friday, the Delhi High Court allowed a one-week interim bail to Mohd Fahad, an undertrial accused in a 2023 case involving the kidnapping and murder of a minor, permitting his temporary release to attend to his father’s imminent surgery, a move that underscores the court’s willingness to balance grave charges with verified humanitarian grounds.
The case arose from an FIR registered at the Hazrat Nizamuddin Police Station, where Fahad faces allegations of kidnapping, murder, destruction of evidence, and criminal conspiracy, alongside two co-accused, with the trial currently at the stage of prosecution evidence. Having remained in judicial custody since April 2023, Fahad sought interim bail, citing his father’s scheduled surgery for a serious medical condition. The defence placed medical records on record and undertook strict compliance with conditions, including surrender upon expiry. The prosecution confirmed verification of the medical documents and raised no objection to the limited relief.
Justice Shail Jain accepted the verified medical material and the State’s stand, concluding that temporary release was warranted in the circumstances. Recording the operative window, the Court directed that the accused be released on interim bail “w.e.f. 03rd January, 2026 to 10th January, 2026,” subject to furnishing a bail bond of Rs. 25,000 with one surety of the like amount and adherence to stipulated conditions.
