Refuting IPS officer Saurabh Tripathi’s allegations that the Angadiya Association had falsely implicated him soon after he had ordered a crackdown on hawala transactions on Nov 15, a Sessions Court observed that the document produced by him appeared to be fabricated.
The Sessions Court made the observations in a detailed order rejecting his anticipatory bail plea, which was made available on Friday. Tripathi (38) is accused of orchestrating extortion of angadias, or traditional couriers.
The Judge said, “Considering the allegations against the applicant (Tripathi), responsibility cast on the applicant by law & material collected . . . , conduct of the applicant while submitting documents in reference to forged resolution, this is not a fit case to grant anticipatory bail,” additional sessions judge R M Sadrani. The court said when comparing the resolution produced by Tripathi & the one with the photocopy of the outward register presented by the prosecution, it was apparently seen that ther e is overwriting on the date in the resolution produced by the accused. “It appears that this document is fabricated to show that soon before the complaint of Angadiya Association dated December 7, 2021, applicant (Tripathi) directed for inquiry in hawala transactions. In fact, this resolution is of month of September, 2021".
The Court noted that Tripathi’s conduct reminded it of a Marathi proverb: “Fence itself is grazing on the crops. ”
The Court said, “Applicant is responsible person holding post of DCP and bound by law to protect the citizens. Applicant is not authorised at all to extract the amount from the persons doing illegal business by using his authority. On the contrary, he has to act diligently to curb the illegal transactions by following the provisions of law".
The police arrested Tripathi’s house help, employed at his home in Lucknow. It is alleged that Tripathi transferred Rs 40 lakh through hawala sources. Tripathi’s lawyer submitted that he had transferred the amount towards maintenance of his parents.
