In a public interest litigation concerning the unauthorized functioning of bars, clubs, and restaurants in Delhi, the Delhi High Court has sought a detailed response from the Delhi Police. A Division Bench led by Chief Justice D.K. Upadhyaya and Justice Tushar Rao Gedela issued notice on a plea alleging widespread violations of excise regulations, with several establishments purportedly operating without requisite licences and serving alcohol beyond permissible hours.
The PIL, filed by petitioner Mahtab Khan, claims that numerous pubs and nightlife venues are routinely flouting licensing norms under the Delhi Excise Act and Rules, resulting in significant revenue losses to the government. The petition further raises concerns over underage alcohol consumption, asserting that certain establishments are facilitating late-night parties and serving liquor until as late as 7:00 AM, often to minors.
According to the petitioner, only L-16 licences issued under the Delhi Excise Rules permit round-the-clock alcohol service. These licences, however, are restricted to establishments situated within five-star or higher category hotels. The plea alleges that many outlets operating well into the early hours either lack such licences or are not qualified to obtain them due to non-compliance with this prerequisite.
The petition further seeks judicial intervention for the immediate suspension of operations of all outlets functioning without valid L-16 or L-17 licences, particularly those violating the permitted hours. It also urges the formation of a joint enforcement task force comprising officials from the Delhi Police and the Excise Department to monitor compliance and take swift action against violators.
The Court has directed the Delhi Police to submit its reply and fixed the matter for further hearing on August 22.
