The woman waived her right to maintenance or alimony & agreed to withdraw cases lodged against the husband & his family on the condition that her former spouse deletes all objectionable & sensitive images of her from all his electronic & storage devices.

In an unusual, but crucial condition for granting a divorce, a man agreed to delete nude pictures of his former wife, including files stored on digital platforms such as mobile phones, pen drives & CDs.

"Appellant (husband) agrees that the pen drive containing the nude photographs of the respondent (woman) be destroyed. The couple also undertook to destroy any other form of digital media storage on which copies of said photographs of the woman are stored or copied," said a division bench comprising Justices K K Tated & B P Colabawala as a condition to granting a divorce to a couple from Pune.

The couple had married in the year 2011, in Pune. A few years later, the woman moved Pune family court seeking divorce on the grounds of cruelty, which was granted. The man's plea for restitution of conjugal rights was rejected, following which he approached Bombay High Court.

Before the high court could hear both sides, the couple settled their differences & agreed to divorce by mutual consent.

The woman waived her right to maintenance or alimony & agreed to withdraw cases lodged against the husband & his family.

Her condition was that her former spouse deletes all objectionable & sensitive images of her from all his electronic & storage devices.

Both former spouses undertook to not file or lodge any civil or criminal complaint/suit/petition against each other in future, arising out of their matrimony.

Furthermore, they will also not interfere with personal as well as professional life.

Accordingly, the court accepted the consent terms & granted a decree of divorce.
