Recently, the Bombay High Court upheld its interim bail order granted to the petitioner pending the hearing of the case. The court confirmed its earlier findings that the petitioner had been detained for more than 24 hours without sufficient justification, violating legal protocols regarding detention.
The High Court Bench also noted the Central Government’s commitment to implementing measures to prevent overnight detentions for interrogation, emphasizing the need for appropriate guidelines in such matters.
In the previous order, the court had granted interim bail on certain terms after reviewing the timeline of the petitioner’s detention as presented by both parties. It highlighted that the petitioner had cooperated with authorities during a GST investigation conducted in 2021, where audits were performed for the years 2017 to 2020. The court found the respondent’s justification for the extended detention, which involved generating GST returns and obtaining a Document Identification Number, to be insufficient and contrived.
The court reiterated its earlier observations, stating that the jurisdiction for the petitioner’s overnight detention lacked reason, especially given the absence of pertinent documents from the respondent. It condemned the practice of detaining individuals overnight under the pretext of recording statements, emphasizing that arrest should not be routine and can severely harm a person’s reputation. The court confirmed the interim bail order, maintaining the same conditions as before.
Additionally, the court accepted the respondent’s assurance that the Central Government would implement measures to prevent such detentions in the future. The Court directed that any guidelines issued by the relevant ministry be presented by the next hearing date. The case is scheduled for compliance review on December 3, 2024.
