Recently, the Supreme Court ruled on a petition challenging the bail condition imposed by the High Court of Tamil Nadu, where the petitioner was required to close his YouTube channel. The case arises from FIR No. 123 of 2024, registered under the Tamil Nadu Prohibition of Harassment of Women Act, 2002, and the Information Technology Act, 2000.
The petitioner, who was granted bail by the High Court in connection with the case, faced an additional condition that mandated the closure of his YouTube channel. Dissatisfied with this direction, the petitioner approached the Supreme Court. On September 6, 2024, the Supreme Court issued an interim order stating the condition related to the closure of the YouTube channel while keeping other bail conditions intact.
The Apex Court noted that imposing such a condition was unnecessary and unrelated to the bail application, the court stated that “Imposition of a condition for shutting down the YouTube channel was unwarranted and extraneous for a decision on the application for bail”. The Court emphasized that the petitioner’s release on bail should not have been contingent on closing the YouTube channel. Consequently, the Supreme Court set aside the High Court’s directive concerning the YouTube channel, confirming its earlier interim order and modifying the High Court's ruling. Hence, The Supreme Court disposed of the Special Leave Petition.
