Bombay High Court has recently granted interim protection to Amravati physio from arrest with conditions.

 

With prima facie view that  no active role has been attributed to the applicant - physiotherapist Ojas Rajendra Panjabi in the incident, which led to the registration of the  FIR by the Frezarpura Police Station in Amravati district on May 18 last, and as such a case for grant of ad-interim protection for arrest is made out, Justice Manish Pitale, at the High Court here, has directed the respondent - Police Station Officer to release the applicant on bail, in the event of his arrest, subject to the furnishing PR Bond of  Rs 25,000/- and a surety in the like amount.
The Court has directed the applicant, by way of conditions attached to the interim protection that he is expected to co-operate with the investigation and will make himself available to the Investigating Officer as and when called. Further, he would not tamper with the prosecution evidence or influence the witnesses.
The applicant has approached the Court seeking anticipatory bail in respect of the FIR registered against him and another accused for the alleged offences punishable under sections 354, 342, 506 and 109 of the IPC and sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012.
According to the prosecution, the reported incident allegedly took place between May 13 and 16, 2019, wherein the main accused is alleged to have harassed a 15 years old minor girl. Allegedly, the main accused took the girl away on his motorcycle to a place called Nature Punjabi Dhaba where the second accused allowed them to use a room in the said premises and for that, the applicant took Rs 1,000/- from the main accused. without asking for the identity card from him.Advocate P.W.Mirza appeared for the applicant. APP H.R.Dhumale represented the respondent-State.
