Mr. S.S. Chaudhary, Standing Counsel, for the State.

Mr. S.S. Chauhan, Advocate, for Uttarakhand Peyjal Nigam. (2) Petitioner retired as Work Supervisor from Uttarkahand Peyjal Nigam, Chamba, District Tehri Garhwal on 31.5.2025. Since his retiral dues have not been released so far, therefore, he has filed this writ petition seeking the following relief:

"i) To issue a writ order or direction in the nature of Mandamus commanding the Respondents to forthwith release the outstanding retiral benefits to the petitioner, details whereof is given herein below:-

A) Gratuity = Rs. 12,16,809/- (approx.) (Sanctioned but not paid) B) Leave Encashment (300 days) = Rs.

7,37,460/- (approx.) (Sanctioned but not paid) Total Amount = Rs. 19,54,269/- (Approx)"

(3) Mr. S.S. Chauhan, learned Counsel appearing for Uttarakhand Peyjal Nigam, fairly submits that petitioner is entitled to the amount as mentioned in the writ petition under various heads. He submits that due to financial constraints, retiral dues could not be released to petitioner so far. He assures that entire outstanding dues of the petitioner would be released as early as possible.

(4) Having regard to the facts and circumstances of the case, writ petition is disposed of by directing the Managing Director, Uttarakhand Peyjal Nigam to 2026:UHC:2128

ensure that the amount of gratuity is released in favour of petitioner positively within two months and amount of leave encashment and other outstanding dues are released in his favour within four months from the date of presentation of certified copy of this order.
