Hon'ble Ashish Naithani, J., Mr. B.S. Negi, learned counsel for the Applicant.

2. Mr. S.S. Chauhan, learned Deputy Advocate General assisted by Mr. Pramod Tiwari, learned A.G.A. and Mr. Vikash Uniyal, learned A.G.A. for the State of Uttarakhand.

3. The present Bail Application has been moved by the Applicant-Birbal Farswan. The Applicant is in judicial custody in connection with FIR No. 0008 of 2026, registered at Police Station Joshimath, District Chamoli, for the offences punishable under Sections 8/20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as the "NDPS Act").

4. Learned counsel for the Applicant submits that the Applicant has been falsely implicated in the present matter and that there are material anomalies in the procedure followed with respect to the arrest and seizure.

5. Learned State Counsel seeks time to file objections.

6. Let objections, if any, be filed by the State.
