2. This first bail application has been moved by the applicant seeking regular bail in Case Crime No.140 of 2025, under Section 105 of B.N.S., 2023, registered at Police Station Raipur, District Dehradun.

3. The applicant and the deceased were in a love relationship for the last one year. On 26.04.2025 at about 06:15 p.m., the applicant entered the room and found the deceased consuming liquor. A sudden scuffle ensued over his drinking, during which the deceased sustained chest injuries from a kitchen knife lying on the table. The applicant promptly took him to a nearby hospital, where he was declared brought dead. The post-mortem report attributes the cause of death to excessive bleeding. The F.I.R. was lodged under Section 105 of the Bharatiya Nyaya Sanhita, 2023, on 04.05.2025.

4. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case and has languished in judicial custody since 07.05.2025. He contends that there was no motive whatsoever for the applicant to kill the deceased, as the two were in a deep love relationship, and their engagement was fixed for 07.06.2025 and their marriage was scheduled to be solemnized on 02.10.2025. He further submits that the charge-sheet has already been filed, yet the trial has not commenced. The applicant undertakes not 2026:UHC:1908 to misuse the liberty of bail if granted and is ready to furnish adequate sureties to the satisfaction of this Court.

5. Learned State Counsel has vehemently opposed the prayer for bail.

Having considered the rival submissions and perused the material on record, this Court finds that no material has been brought on record to indicate that the applicant would tamper with evidence or influence witnesses if enlarged on bail. The incident appears to stem from a sudden scuffle in a loving relationship, with no premeditated motive, as evidenced by their fixed engagement on 07.06.2025 and impending marriage on 02.10.2025. The applicant has remained in judicial custody since 07.05.2025, the charge-sheet stands filed, yet trial is yet to commence. In these circumstances, without expressing any opinion on the merits, the applicant is entitled to be released on bail at this stage.

7. The bail application is allowed.

8. Let the applicant, namely, Radhika Singh be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
