Mr. Niranjan Bhatt, learned counsel for petitioner-Society.

2. Mr. Ganesh Kandpal, learned D.A.G. for the State of Uttarakhand/respondent Nos.1 to 7.

3. This writ petition has been filed by the petitioner-Society for the following reliefs:-

(i). Issuance a writ, order or direction in the nature of Mandamus commanding and directing the respondents to conduct a detailed enquiry under Special Investigation vis-à-vis grievances raised in representation dated 12.7.2025 and 16.8.2025 (annexed as Annexure No.3 and 4 to this writ petition) regarding unauthorized and illegal selling of properties of the Udasin Sampradaya (including charitable properties belonging to the Udasin Sect) by the respondent no.8.

(ii). Issue a writ, order or Direction in the nature of mandamus directing and commanding the respondent no.1 and 2 to decide the representation dated 12.7.2025 and 16.8.2025 submitted by the petitioner. (annexed as Annexure No.3 and 4 to this writ petition).

4. In substance, the petitioner-Society wants to protect its property by filing the present writ petition.

5. It is contended by learned counsel for petitioner that some of the respondents 2026:UHC:1832

are trying to sell out the property of the petitioner-Society and some or the property has already been sold out, therefore, petitioner wants an enquiry to be conducted in the matter.

6. This prayer appears to be misconceived, as such order cannot be passed.

7. Accordingly, the present writ petition is dismissed. However, if the petitioner- Society feels that there is threat of transferring of its property, it can maintain a civil suit in respect of its property under the private law remedy.

8. Pending application(s), if any, stands disposed of.
