2. Mr. Vipul Painuly, learned A.G.A for the State of Uttarakhand.

3. The matter is fixed for hearing on the Bail Application of the Appellant.

4. Heard learned counsel for the parties on the Bail Application (I.A. No. 01 of 2025).

5. Learned counsel for the Applicant submits that the Appellant was on bail during the trial and he never misused the liberty granted by the learned Trial Court. It is further submitted that the Appellant has no criminal history. Learned counsel further submits that the Appellant is in jail since 16.01.2025 and has already undergone more than two and a half years of incarceration.

6. Learned State Counsel submits that the allegations are serious in nature as the injuries caused are life-threatening, and therefore the Appellant is not entitled to bail.

7. This Court has considered the rival submissions and perused the material available on record. The allegations against the Appellant are serious in nature and the injuries caused are also serious.

8. Considering the gravity of the offence and the overall facts and circumstances of the case, and without expressing any opinion on the merits of the appeal, this Court is not inclined to enlarge the Appellant on bail at this stage.

9. Accordingly, the Bail Application (I.A. No. 01 of 2025) is rejected.

10. However, since the Appellant is in custody, the Registry is directed to ensure that the paper book is prepared, if not already prepared, and list this Criminal Jail Appeal on 20.05.2026 for final hearing.
