2. Mr. Vikas Uniyal, learned Brief Holder for the State.
3. By means of present bail application applicant has sought his release from jail in connection with FIR No.213 of 2025 under Section 8/22 of N.D.P.S. Act, P.S. Haldwani, District Nainital.
4. Heard learned counsel for the parties.
5. Learned counsel for the applicant submits that applicant is an innocent person and he has been falsely implicated in the aforesaid case. He submits that applicant is languishing in jail since 07.07.2025 and more than 180 days he is in custody and yet charge sheet has not been filed by the police. He submits that applicant has no previous criminal history.
6. Learned State counsel has opposed the bail application.
7. Considering the overall facts and circumstances of the case without expressing any opinion on the merits of the case, applicant deserves bail.
8. Accordingly, bail application is allowed. Let the applicant-Tannu Gupta be released on bail on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of court concerned.
