Mr. M.C. Pant, learned counsel for the petitioners.
2. Mr. Pradeep Hairiya, learned Standing Counsel for the State of Uttarakhand.
3. Petitioners were engaged as daily wager to discharge duties as MALI in Horticulture Department on different dates. According to them, they have served continuously for more than ten years, however, their claim for regularisation was wrongly rejected vide order dated 12.10.2017. Thus, feeling aggrieved, petitioners have approached this Court.
4. Learned counsel for the petitioners submits that the reason assigned in the rejection order is that case of petitioners is not covered by Regularisation Rules, as originally framed in 2013. He submits that the Regularisation Rules 2013 have been amended in December, 2025, and now the case of the petitioners is covered by the amended Rules. He further submits that another reason assigned for not regularising petitioners is that they have not undergone requisite training and now all the petitioners have completed the prescribed training for regular appointment. Thus, he submits that writ petition may be disposed of by directing the Competent Authority to reconsider the case of the petitioners for regularisation, as per the amended 2026:UHC:1699
Rules.
5. The writ petition is, accordingly, disposed of with liberty to petitioners to make separate representation within two weeks from today. If they make representation(s) within the stipulated time, claiming regularisation, the Competent Authority shall take decision thereupon, as per the law, within three months thereafter. It goes without saying that the Competent Authority shall refer the case of the petitioners to the Regularisation Committee, if they are found eligible and Regularisation Committee shall pass necessary order within the stipulated time.
6. Needless to mention here that reconsideration of claim of petitioners shall be without being influenced by the earlier order impugned in this writ petition.
