2. Mr. S.S. Chaudhary, Standing Counsel for the State of Uttarakhand/respondents.

3. Petitioner is serving as Principal in Government Polytechnic. Presently she is posted at Bhimtal, District Nainital. She made a representation seeking transfer to Dehradun, which has been rejected by the Secretary, Technical Education, Government of Uttarakhand, vide order dated 30.04.2024.

4. Learned counsel for the petitioner raised various submissions, which we are not inclined to consider at this stage, as law is well settled that transfer is an incidence of service and it is for the employer to decide where to post a particular employee. However, having regard to the submission made by learned counsel for the petitioner that petitioner has served at durgam places for sufficiently long period of time, she is permitted to make fresh representation to the competent authority, indicating ten places, as per order of preference, where she wants to be posted. If such representation is made within two weeks, decision thereupon shall be taken 2026:UHC:1670-DB before the next transfer season. The competent authority shall take independent decision on the representation, untrammelled by any observations, made in the impugned order.

5. The writ petition stands disposed of accordingly.
