Heard Mr. B.D. Pande, learned counsel for the petitioner and Mr. Mohd. Azim, learned counsel for the respondents.

2. On 24.09.2019, the Coordinate Bench directed that the petitioner shall not be evicted from the premises in question pursuant to the impugned order, provided petitioner pays a sum of Rs.1,500/- per month w.e.f. October, 2019 for use and occupation of the premises in question on or before 7th day of each succeeding month to the landlords (respondents herein), without prejudice to his rights and contentions.

3. On 19.02.2026, Mr. M.S. Tyagi, learned Senior Advocate, appearing for the respondents, submitted that the petitioner is not paying rent. The petitioner was directed to appear in- person before this Court. The petitioner is not present in-person.

4. Mr. B.D. Pande, Advocate, submitted on instructions that some amount has not been paid as directed by the Coordinate Bench on 24.09.2019. However, the petitioner is seeking time to hand over peaceful possession of the suit property to the respondents and for this purpose, he (petitioner) has sought two weeks' time to file his affidavit.

5. Time is granted to the petitioner. Petitioner has failed to comply with the order dated 24.09.2019, therefore, interim order dated 24.09.2019 is vacated.
