Hon'ble Alok Kumar Verma,J.

This Writ Petition has been filed under Article 227

of the Constitution of India with the following prayers:-

"(I) Issue a writ, order or direction, directing the Court of learned 2nd Additional Civil Judge (Jr. Div.), Dehradun to decide and conclude the proceedings of OS No. 96 of 2023, Vijay Kumar Jain Vs. Rajendra Kumar Gupta, very very expeditiously, within the stipulated time, which this Hon'ble court deem fit and proper in facts and circumstances of the case.

(II) Issue any other order or direction which this Hon'ble High Court may deem fit and proper in the facts and circumstances of the case.

(III) To award cost of the petition to the Petitioner."

2. Heard Mr. Rajendra Arya, learned counsel for

the petitioner.

3. Mr. Rajendra Arya, Advocate, appearing for

the petitioner-plaintiff submitted that the said Original

Suit, filed for partition, is fixed for settlement of issues.

4. In the facts and circumstances of the case,

the learned IInd Additional Civil Judge (Junior Division),

2026:UHC:1575 Dehradun is directed to make an endeavour to conclude

the proceedings of the said Original Suit No. 96 of

2023, "Vijay Kumar Jain Vs. Rajendra Kumar Gupta",

expeditiously, as per law, without granting any

unnecessary adjournment to either party.

5. The Writ Petition (WPMS No.556 of 2026) is

disposed of accordingly.

6. It is made clear that this Court has not

expressed any opinion on the merit of the case.
