Hon'ble Alok Kumar Verma,J.

The Application for temporary injunction, filed

by the petitioner-plaintiff in Original Suit No. 36 of 2024,

"Mohan Chandra Joshi Vs. Tika Singh Bisht", was

dismissed. A Miscellaneous Civil Appeal (No. 8 of 2024)

was filed against the said order dated 23.09.2024, passed

by learned Civil Judge (Senior Division), Kotdwar, District

Pauri Garhwal. The Miscellaneous Civil Appeal has been

dismissed vide judgment dated 22.11.2024, passed by

learned Additional District Judge, Kotdwar, District Pauri

Garhwal.

2. Heard Mr. Piyush Garg, learned counsel for the

petitioner-plaintiff and Mr. Nikhil Singhal, learned counsel

for the respondent-defendant.

3. Mr. Nikhil Singhal, Advocate, submitted on

2026:UHC:1608 instructions that this writ petition may be disposed of by

directing the trial court to decide the Original Suit No. 36

of 2024 within six months.

4. Mr. Piyush Garg, Advocate, appearing for the

petitioner, on instructions, has not opposed the said

request. However, he has submitted that both the parties

should be directed to maintain status quo over the suit

property until then.

5. Learned counsel appearing for both the parties

submitted that the parties shall not take any unnecessary

adjournment in the original suit.

6. In view of the above, the present writ petition

(WPMS No. 3693 of 2024) is disposed of by directing the

trial court to make an endeavour to decide the Original

Suit No. 36 of 2024 within six months from the date of

production of certified copy of this order, as per law, and,

without granting any unnecessary adjournment to either

party, and in the meantime, both the parties shall

maintain status quo over the suit property.

7. It is made clear that this Court has not

expressed any opinion on the merit of the case.
