(2) This writ petition has been filed by Delhi Arya Pratinidhi Sabha and Arya Pratinidh Sabha, Haryana challenging the order dated 6.5.2016, passed by Registrar, Firms, Societies and Chits, Dehradun. In the said order, Registrar has held that there is no provision in the byelaws of Arya Vidya Sabha, Gurukula Kangri, Haridwar that Arya Pratinidhi Sabha, Delhi, Haryana and Punjab will have any role to play in constituting the Managing Committee. (3) The finding recorded by Registrar is contrary to para 4 of the byelaws, which provides that General Body of Haridwar Arya Vidya Sabha shall consist of 45 members, out of which 9 members each will be from Arya Pratinidhi Sabha, Punjab, Haryana and Delhi. The composition of Haridwar Arya Vidya Sabha, as per para 4 of the byelaws, is given in internal page-4 of the impugned order. Thus this Court finds substance in the submission made by learned Counsel for the petitioners that the finding recorded by Registrar on the aforesaid aspect is perverse and contrary to the specific provisions of the byelaws governing the field.

(4) In such view of the matter, the finding recorded by Registrar in second para of internal page-10 of the impugned order is liable to be set aside and is hereby set aside. Writ petition is allowed. Competent authority is directed to hold elections strictly as per the applicable byelaws within four months from the date of presentation of certified copy of this order.
