Mr. Devansh Sehgal, learned counsel for the Appellant/Applicant.

2. Mr. G.C. Joshi, learned AGA for the State.

3. Present criminal appeal is filed by the appellant against the judgment and order dated 28.08.2025 passed by learned IInd Additional District & Sessions Judge, Haldwani, Nainital in Session Trial No.59 of 2023 State vs. Lalit Gusain (FIR No.402 of 2023) under Section 307 of IPC, Police Station Haldwani, District Nainital. By the said judgment appellant/applicant was convicted under Section 307 of IPC and sentenced to five years rigorous imprisonment alongwith a fine of Rs.10,000/- and in default stipulation one month additional rigorous imprisonment was imposed upon him.

4. The matter is listed for disposal of bail application.

5. Learned counsel for the applicant submits that applicant was on bail during trial and he has never misused the same.

6. List on 18.05.2026.

7. Heard on bail application.

8. Without going into the merits of the case and considering the fact and circumstances of the case, this court finds it sufficient to enlarge the applicant on bail.

9. Let the applicant-Lalit Gusain be released on bail on his furnishing a personal bond and two sureties of the like amount to the satisfaction of the court concerned during the pendency of this appeal.
