BA1 No. 334 of 2026
Nitin Kumar --Applicant
Versus
State of Uttarakhand --Respondent
Hon'ble Ashish Naithani, J.
Mr. S.R.S. Gill, learned counsel for the Applicant.
2. Mr. Pramod Tiwari, learned A.G.A. along with Mr. Vikas Uniyal, learned Brief Holder for the State of Uttarakhand.
3. The Applicant is in judicial custody in connection with Range Case No. 49/Roorkee/2025-2026, registered at Police Station Chalani, Forest Department, District Haridwar, under Sections 2, 9, 12, 39, 40(2), 44, 49, 50 & 51 of the Wildlife (Protection) Act, 1972.
4. Learned counsel for the Applicant submits that the Applicant collects venom for therapeutical use and had been licensed by the Forest Department. However, in the present case, the said license had expired, and the Applicant has been unnecessarily alleged to have been harbouring wild cobras and extracting venom from them, whereas the cobras were provided by the Forest Department itself.
5. Learned State Counsel, however, refutes the submissions advanced by the learned counsel for the Applicant and seeks time for filing objections to the bail application.
6. List this case on 24.03.2026.
7. In the meantime, objections be filed by the State.
