JUDGMENT :

(per Shri Manoj Kumar Gupta, C.J.)

1. The petitioner firm, being aggrieved by a condition

in the tender document that the bidder should be having 'no

litigation', filed the present Writ Petition, challenging the said

condition.

2. A Coordinate Bench, by order dated 07.01.2026,

granted order in favour of the petitioner, and restrained the

respondents from going ahead with the tender process.

3. A counter affidavit has been filed on behalf of

respondent no. 1, and therein the stand taken is that they are

having technical problem in modifying the bid condition, and,

since the bid was for procurement of photostat machines for

2026:UHC:1467-DB

urgent need, therefore, the respondents have decided to

cancel the present bidding process, and invite fresh tenders.

4. Learned counsel for the petitioner submits that, in

view of the said stand taken by the respondents, the grievance

stands redressed.

5. Having regard to the aforesaid, the present Writ

Petition is disposed of, as having become infructuous. The

respondents shall abide by the stand taken by them in their

counter affidavit, and cancel the present bidding process.

6. All pending applications stand disposed of

accordingly.
