IN THE HIGH COURT OF UTTARAKHAND AT NAINITAL

THE HON'BLE CHIEF JUSTICE MR. MANOJ KUMAR GUPTA

                                 AND

THE HON'BLE JUSTICE MR. SUBHASH UPADHYAY

               Writ Petition (M/B) No.136 of 2026

                             9 March, 2026

  Pradeep Singh Tomar --Petitioner

                                  Versus

Executive Engineer Rural Works Department and Others
                                                      --Respondents
  ----------------------------------------------------------------------
  Presence:-
Mr. Shailendra Nauriyal, learned counsel for the petitioner.
Mr. Gajendra Tripathi, learned Standing Counsel for the State of
  Uttarakhand.
  ----------------------------------------------------------------------
  JUDGMENT :

(per Mr. Manoj Kumar Gupta C. J.)

1. The present writ petition has been filed praying

for quashing of the advertisement dated 20.02.2026

issued by respondent no.2 inviting tenders for

construction of toilet in Government Primary School

Ashti.

2. It seems that the same work was earlier

allotted to the petitioner vide work order dated

08.12.2025.

3. Learned counsel for the petitioner submits that

the respondents have issued the impugned

2026:UHC:1497-DB advertisement without giving any notice or opportunity of

hearing to the petitioner.

4. Even on specific query made to learned counsel

for the petitioner as to whether his contract is still

subsisting he is not in a position to make any statement.

5. Unless the contract is still subsisting the

petitioner cannot prevent the respondents from re-

advertising the work.

6. As there is no clarity on the said aspect,

therefore, we find no merit in the writ petition and the

same is, accordingly, dismissed.

7. Pending application, if any, also stands

disposed of.
