Mr. Harshit Bisht, learned counsel, holding brief of Mr. Siddhartha Sah, learned counsel for the appellant.
2. Mr. Tapan Singh, learned counsel for the respondents.
3. In the instant appeal against the judgment and order dated 04.09.2024, passed by the learned Motor Accident Claim Tribunal/District Judge, Haridwar in MACP No. 117 of 2022, a money withdrawal application has been filed by the claimants.
4. Learned counsel for the appellant has orally objected to the money withdrawal application.
5. Having regard to the facts and circumstances of the case, Money Withdrawal Application No. 3 of 2025 is allowed. Learned Tribunal is directed to release 50% of the deposited amount in favour of the claimants- respondents proportionately, without asking any security. The remaining amount shall be invested in an interest bearing scheme of a nationalized bank.
6. AO No. 301 of 2025 has wrongly been connected with this appeal. Therefore, de-link AO No. 301 of 2025 from the present appeal from order.
7. List this matter in due course, alongwith AO No. 389 of 2025.
