Heard on IA No.4 of 2025 for Money Withdrawal Application The instant appeal is preferred against the award dated 07.06.2024, passed in MAC No.07 of 2020, Smt. Sita Devi and Others Vs. The Oriental Insurance Company Limited and Another, by the Motor Accident Claims Tribunal/District Judge, Pauri Garhwal.

When the matter was taken by this Court on 13.06.2025, this Court had directed the appellant to deposit Rs. 45 Lakhs against the total awarded amount of Rs. 58,39,000/-. The amount was so deposited and on the application of the parents of the deceased, Rs.15 Lakhs were released in their favour proportionally by this Court on 19.09.2025. Now, another claimant, who is the respondent no.1/the wife of the deceased, has filed money withdrawal application.

Since two of the claimants have already been given Rs.15 Lakhs out from the deposited amount, the money withdrawal application of the respondent no.1/Sita Devi also deserves to be allowed.

The money withdrawal application is allowed.

Let Rs. 7.5 Lakh be released in favour of the respondent no.1/Sita Devi. The amount shall be released without taking any security. It shall be transmitted in her account. For this purpose, the respondent no.1/Sita Devi shall file an application giving details of her account number.

It shall be verified first, and only thereafter, the amount shall be deposited in their account.
