The appellants are claimant in MACT Case No.13 of 2018, Smt. Rajeshwari Devi and Others Vs. Reliance General Insurance Company Ltd. and Another, which was decided on 02.12.2019 by the court of Motor Accident Compensation Tribunal, Uttarkashi. The appellants claim enhancement.

The appeal is delayed. The Delay Condonation Application, IA No.1 of 2021, has been filed.

Heard.

Learned counsel for the appellants submits that the appellants could not contact their counsel; the appellant no.1 is a widow; there was a lockdown during that period; she could not contact her lawyer immediately; she had some financial constraints also, and in that process, delay occurred in preferring the appeal.

Learned counsel for the respondent no.1 submits that the appeal is quite delayed; the delay has not been explained. Therefore, the delay condonation application deserves to be rejected.

Having considered, this Court is of the view that there are good grounds to condone the delay.

The delay in preferring the appeal is condoned.

The delay condonation application is allowed.

Let call for the LCR.
