Heard Mr. Abhishek Anthwal, learned counsel for the appellant.

2. The present first appeal has been preferred against the judgment dated 23.04.2024 passed by the learned court of 9th Additional Civil Judge (Senior Division), Dehradun in Original Suit No.406 of 2015 (Shri Anil Kumar Sharma vs. Shri Rajendra Singh Biroria & others), whereby the suit of the respondent no.1 has been decreed against the appellant.

3. Since it is a regular first appeal.

4. Admit.

5. Issue notices to the respondents, returnable within two weeks. Steps to be taken within one week.

6. However, since the suit has partially been decreed and it has been directed that an amount of `3,00,000/- (Three Lakhs) to be paid by the defendant no.1 to the plaintiff along with 6% per annum interest.

7. In view of the Order 41 Rule 5 of C.P.C., the proceedings of the execution of impugned judgment and decree dated 23.04.2024 passed by the learned court of 9th Additional Civil Judge (Senior Division), Dehradun in Original Suit No.406 of 2015 (Shri Anil Kumar Sharma vs. Shri Rajendra Singh Biroria & others) shall remain stayed, subject to deposit of the entire decretal amount before the Executing Court within a period of 45 days.
