The Trial Court had dismissed the Application of the petitioner-plaintiff, filed for temporary injunction in Original Suit No. 54 of 2023, "Hari Singh alias Harish Singh Vs. Smt. Ganga Devi and Another". A Miscellaneous Civil Appeal (No.2 of 2024) was filed by the petitioner. The said appeal has been dismissed vide judgment dated 26.09.2025, passed by learned Ist Additional District Judge, Haldwani, District Nainital.

2. Heard Mr. T.A. Khan, learned Senior Advocate assisted by Mr. Mohd. Shafy, learned counsel for the petitioner.

3. Mr. T.A. Khan, Senior Advocate, has contended that the petitioner-plaintiff is recorded as bhumidhar with transferable rights in the revenue records.

4. Notice is being issued to the respondents. Steps to be taken within a week.

5. List on 18.04.2026. Till then, both the parties are restrained from creating any third party interest over the suit property.
