1. Mr. Bhuwan Bhatt, learned counsel for the petitioner.

2. Mr. Pooran Singh Bisht, learned Additional Chief Standing Counsel for the State of Uttarakhand.

3. The petitioner places reliance on the minutes of the meeting dated 17.08.2022 held under the chairmanship of the Chief Secretary, Uttarakhand Government, whereby recommendation was made to accord Special Dynamic Assured Career Progression (SDACP) to the doctors working under the Ayush Department, namely, Ayurvedic and Unani Doctors. It is submitted that the petitioner, who is working as an Ayurvedic Doctor, is performing the same duty as the Allopathic Doctors and those working as Dentists. Thus, the claim is on the basis of parity.

4. Learned Additional Chief Standing Counsel has placed on record a communication received from the Director, Ayurvedic and Unani Services, Uttarakhand, Dehradun, in which the stand taken is that the Department of AYUSH provides the benefit of MACP to Ayurvedic Medical Officers as per the Uttarakhand AYUSH (Ayurvedic and Unani) Department Service Rules, 2010 and; the SDACP is not applicable to the Department of AYUSH in Uttarakhand. It is also stated that according the benefit of SDACP is a matter of policy and the decision, in this regard, has to be taken by the State Government.

5. Having regard to the aforesaid, we require the Additional Chief Standing Counsel to seek specific instructions from respondent No. 1 with regard to the stand of the Government in the matter. He is also given liberty to file counter-affidavit on the said aspect within three weeks.
