By means of the present application under Section 528 of the BNSS, the applicant seeks quashing of the order dated 10.06.2024, passed by the learned Civil Judge (Junior Division)/Judicial Magistrate, Laksar, District Haridwar, in Criminal Case No. 1558 of 2022, and also seeks quashing of the judgment and order dated 16.12.2025, passed by the Additional District and Sessions Judge, Laksar, District Haridwar, in Criminal Revision No.43 of 2024.
4. Counsel for the applicant makes a submission that the entire case of the complainant arises out of an alleged transaction relating to sale, registration, and finance of a tractor, which at best gives rise to civil liability, and that the criminal proceedings have been initiated only to give a criminal colour to a purely civil dispute, which is impermissible in law.
5. In such view of the matter, issue notice to the respondent no.2.
6. Steps to be taken within four days.
7. As an interim measure, it is provided that till the next date of listing, further proceedings of Complaint Case No.220 of 2022, pending before the Judicial Magistrate, Laksar, District Haridwar shall remain
stayed.
8. List on 25.02.2026.
9. Interim relief application (IA No.1/2026) stands disposed of accordingly.
